In Dakota Wilson v Muhammad Tofa and American United Transportation Inc.,
Civil Court, Kings County, New York, Judge Odessa Kennedy
The plaintiff, a pedestrian who was 17 years old at the time of the accident, told police at the scene, he was crossing in the middle of the block. At trial he told the story that the reason he was crossing in the middle of the block was because a police traffic stop was blocking the crosswalk. Plaintiff’s attorney tried to convince the jury that the cab driver should have been more careful because the accident was near a large public park and a bus stop. Mr. Recchia represented the defendants, whose cab driver testified credibly. The jury rendered a unanimous defense verdict on liability within 20 minutes of deliberation.
