Lee-David Weiner Wins Summary Judgment Dismissing Plaintiff’s Negligent Security Case In New York Co

On December 19, 2017, Lee-David Weiner won summary judgment dismissing the plaintiff’s complaint and all cross-claims in Folan v. Bonsignore, Index No. 116645/2009 (Supreme Court, New York County). The plaintiff claimed that he sustained multiple facial fractures requiring surgery in an altercation at our client’s bar, and claimed that our client was negligent by virtue of failing to provide adequate security at the premises. Mr. Weiner argued that the actions of the co-defendant, who struck the plaintiff, were sudden and unforeseeable requiring dismissal of the negligent security claim. The Court agreed and dismissed the plaintiff’s complaint and all cross-claims against our client.
