Steven Dyki Wins Defense Verdict In Kings County Labor Law Case

On November 22, 2016, Steven Dyki won a defense verdict in Crawford v. The North Flats, LLC, Index No. 13076/2013 (Sup. Ct. Kings County). The plaintiff claimed that he fell when an extension ladder he was using to descend from the mezzanine level of an apartment under construction collapsed. He brought claims for negligence and violation of Labor Law sections 200, 240 and 241(6) against the defendant owner and general contractor. The owner and general contractor brought third-party claims against the plaintiff’s employer, a subcontractor at the construction project. In representing the plaintiff’s employer, Mr. Dyki argued that the plaintiff’s version of events was not believable because there was no credible evidence to support that an extension ladder was present, and the credible evidence demonstrated that only an A-frame ladder was present in the area and that plaintiff was not descending from the mezzanine when the accident occurred. The jury returned a defense verdict.
