John Komar Prevails At Trial In Queens County

On May 31, 2016, John Komar prevailed at trial in Matarrese v. Umer, Index No. 21789/2013 (Sup. Ct. Queens County). The plaintiff’s vehicle was stopped at a traffic light and struck by the defendant’s vehicle. The plaintiff claimed to have sustained a partial thickness tear of the rotator cuff of the left shoulder requiring arthroscopic surgery, and herniated discs at C5-6 and C6-7. After a damages only trial in which the plaintiff asked the jury for $350,000 in damages, the jury returned a verdict awarding only $20,000.
