On May 20, 2016, Maurice Recchia authored an article for the New York Law Journal on the recent Court of Appeals decision, Sherman v. New York State Thruway Authority, which addresses the question of what constitutes an “ongoing storm” for the purposes of the “storm in progress” doctrine that provides that a property owner will not be held liable in negligence for a plaintiff’s injuries sustained as a result of an icy condition during an ongoing storm or for a reasonable time thereafter.
