Marcin Kurzatkowski Prevails on Appeal in Second Department

On February 11, 2015, Marcin Kurzatkowski prevailed on appeal in the case of Morris v. Chase Bank, 2015 NY Slip Op 01249 (2nd Department 2015). The plaintiff alleged that he was assaulted while attending a Halloween dinner at a property owned or controlled by Chase Bank. The Court below granted Chase Bank’s motion to dismiss the plaintiff’s complaint for failure to state a cause of action because the plaintiff failed to allege facts to demonstrate that Chase Bank owed him a duty of a care. The decision was affirmed on appeal.
