Steven Dyki Wins Declaratory Judgment Action in Monroe County

On February 26, 2015, Steven Dyki won summary judgment dismissing the plaintiff’s complaint and all claims against Technology Insurance Co. in Landsman Development Corp. v. RLI Insurance Co., Index No. 2013/03526 (Supreme Court, Monroe County). Mr. Dyki successfully argued that the blanket additional insured endorsement of an insurance policy did not provide for coverage to Landsman Development Corp. in a claim for violation of Labor Law section 240. The underlying action involved a construction worker who fell from a scaffold onto a vertical pipe causing an impalement injury.
