David Gould, Lauren Garvey and Matthew Biondi Win Summary Judgment with Collateral Estoppel Argument

On December 19, 2014, David Gould, Lauren Garvey and Matthew Biondi won summary judgment dismissing the plaintiff’s complaint in James v. Claude, Index No. 9413/2013 (Supreme Court, Kings County). Our attorneys successfully argued that the issue of liability for the accident had been previously determined, and the defendant was found free from liability, following a trial in the case of Eveready Insurance Company a/s/o James v. Claude, Index No. CV-68105/11/BX (Civil Court, Bronx County). The Court granted summary judgment finding that the plaintiff was collaterally estopped from relitigating the issue of liability.
