Marie Castronuovo Wins Summary Judgment in New York County

Marie Castronuovo recently won summary judgment in New York County in the case of Cordero v. Met Foods. Although plaintiff alleged the defendant was negligent in allowing a wet condition to accumulate on the floor at the front registers, Ms. Castronuovo successfully argued, among other things, that defendant had inspected the floor within an hour prior to the accident and found no wet condition at that time. Further, Ms Castronuovo established that plaintiff’s description of the condition as “clear water with dirty track marks under it” indicated that the floor itself was dirty, not the water. Therefore, the water could not have been on the floor for a sufficient period of time for defendant to discover it. Judge Aarons agreed and granted defendant summary judgment.
